A police officer may look at green plant material and call it marijuana.
A vape cartridge may be labeled "THC."
A gummy package may say "Delta-8," "Delta-9," "THCA," or "hemp."
None of those labels necessarily answers the ultimate legal question.
In a Texas criminal case, the State must prove that the substance actually falls within the criminal statute charged.
That can make laboratory evidence critical.

- What exactly did police seize?
- What did the laboratory actually test?
- Which cannabinoid did the laboratory identify?
- Was concentration measured?
- Did the laboratory distinguish Delta-8 from Delta-9?
- Was THCA separately analyzed?
- Was every seized item tested, or only a sample?
- And what law applied on the date of the alleged offense?
Marijuana and Hemp Are Not Legally Identical
Texas law distinguishes hemp from marijuana based primarily upon the applicable THC concentration and statutory definitions.
Under the Texas hemp framework, qualifying hemp and consumable hemp products are tied to a Delta-9 THC concentration not exceeding 0.3% on a dry-weight basis.
That means a substance can look, smell, and even test broadly "positive for THC" without necessarily answering whether it is legally marijuana rather than hemp.
A meaningful criminal analysis requires more precision.
Appearance Alone Does Not Measure THC Concentration
Hemp and marijuana can be visually similar.
Odor can also overlap.
An officer's observation may provide investigative information, but it does not quantitatively establish Delta-9 THC concentration.
A prosecution that depends upon distinguishing legal hemp from illegal marijuana may therefore require reliable chemical analysis rather than appearance alone.
What Does the Laboratory Actually Need to Determine?
That depends upon the charge.
In a plant-material case, relevant questions may include:
- Is the substance cannabis?
- What cannabinoid compounds are present?
- What is the Delta-9 THC concentration?
- Is the concentration above the applicable hemp threshold?
- Was the result reported on a dry-weight basis?
- What methodology was used?
- What measurement uncertainty applies?
In a manufactured-product case, additional questions may arise concerning:
- Delta-8 THC;
- Delta-9 THC;
- THCA;
- other tetrahydrocannabinols;
- concentration;
- product formulation;
- batch identity;
- labeling;
- certificate of analysis; and
- whether the tested sample actually represents the entire seized product.
"THC Positive" May Not Be Enough
A laboratory report that simply says:
THC detected
may leave important questions unanswered.
- Which THC?
- At what concentration?
- Was Delta-8 distinguished from Delta-9?
- Was the substance plant material, an oil, a gummy, or another manufactured product?
- Was quantitative testing performed?
The answer can matter because different cannabinoids and different concentrations may have different legal consequences.
Delta-9 THC and the 0.3% Threshold
Texas's consumable-hemp framework permits qualifying hemp products containing Delta-9 THC at a concentration of not more than 0.3% on a dry-weight basis, subject to the applicable statutory and regulatory requirements.
DSHS also requires consumable hemp products to be properly tested and labeled, and current labeling rules include certification that the Delta-9 concentration does not exceed 0.3%.
That makes quantitative analysis particularly important in a case where the State claims a product exceeds the lawful hemp threshold.
Dry Weight Matters
The statutory threshold is not simply:
"Does the product contain some Delta-9 THC?"
The issue is the concentration on a dry-weight basis.
That distinction can matter for:
- plant material;
- gummies;
- beverages;
- oils;
- concentrates;
- edibles; and
- other manufactured products.
A laboratory result should be read carefully to determine what denominator and testing method were used.
Laboratory Measurement Has Uncertainty
Scientific measurements are not infinitely precise.
Texas hemp regulations expressly recognize laboratory measurement uncertainty in determining an acceptable hemp THC level.
That can become important when a reported result is close to the statutory threshold.
A number such as:
- 0.29%
- 0.31%
- or 0.33%
should not automatically be treated as though measurement precision is unlimited.
The laboratory's method, uncertainty, calibration, and reporting practices may matter.
Delta-8 Requires a Different Analysis After 2026
Delta-8 THC has been the subject of major Texas litigation and regulatory changes.
In 2026, the Texas Supreme Court's decision in Texas Department of State Health Services v. Sky Marketing Corp. materially changed the legal landscape.
DSHS now states that Delta-8 THC is a controlled substance and that only naturally occurring trace amounts of Delta-8 THC in the hemp plant from which the consumable hemp product was manufactured are permissible.
DSHS also states that the relevant scheduling clarification became effective July 31, 2026.
That makes the date of the alleged offense especially important in Delta-8 cases.
The Date of the Alleged Offense Matters
A criminal case should be analyzed under the law applicable when the alleged conduct occurred.
In a 2026 Delta-8 case, counsel should identify:
- the alleged offense date;
- the substance allegedly possessed;
- the specific cannabinoid identified;
- the concentration reported;
- the law and controlled-substance schedule in effect on that date; and
- whether later regulatory developments are being improperly applied to earlier conduct.
Later legal changes should not simply be assumed to create retroactive criminal liability.
THCA Can Create Additional Questions
THCA is chemically related to Delta-9 THC but is not identical to it.
Heating can convert THCA into Delta-9 THC through decarboxylation.
That means the significance of a THCA result depends upon:
- the applicable statute;
- testing method;
- whether total THC or Delta-9 alone is relevant;
- sample preparation;
- product type; and
- the legal issue actually charged.
A laboratory report should not be simplified into "THC equals marijuana" without examining what was actually measured.
Certificates of Analysis Can Matter
Commercial hemp products often include or link to a Certificate of Analysis, commonly called a COA.
A COA may identify:
- batch or lot number;
- cannabinoid profile;
- Delta-9 concentration;
- Delta-8 concentration;
- THCA;
- other cannabinoids;
- laboratory name;
- testing date; and
- methodology.
Texas labeling requirements also contemplate batch/lot information and a URL linking to a certificate of analysis for consumable hemp products.
A COA does not automatically control a criminal case.
But it can provide important evidence concerning what the manufacturer claimed the product contained and whether the seized item matches the tested batch.
The State's Lab and the Manufacturer's COA May Disagree
If the State laboratory reports one result and a manufacturer COA reports another, the discrepancy should be investigated.
Questions may include:
- Were the tests performed on the same batch?
- Were different testing methods used?
- Was the State's sample representative?
- Was the product stored differently?
- Was the COA authentic?
- Did either lab measure only some cannabinoids?
- Was the State's test qualitative or quantitative?
The existence of conflicting laboratory evidence does not automatically resolve the case.
It creates a scientific issue that deserves analysis.
Police Field Tests Have Limits
Roadside or field tests may be useful as preliminary investigative tools.
But they generally do not replace full laboratory analysis when the legal issue depends upon:
- specific cannabinoid identity;
- concentration;
- dry-weight calculation;
- Delta-8 versus Delta-9;
- or another quantitative distinction.
A presumptive field test and a forensic laboratory test are not the same thing.
Gummy and Edible Cases Can Be Especially Complicated
Suppose police seize a package containing 20 gummies.
The laboratory tests one gummy.
Can the State automatically claim that all 20 contain the same controlled substance?
Not necessarily.
Relevant questions include:
- Were all gummies from the same sealed package?
- Did they share the same batch number?
- Were they visually identical?
- Was there a COA?
- Did the lab use a representative-sampling method?
- Did the laboratory homogenize multiple units?
- Was only one item tested?
- What basis exists for attributing the tested result to the untested units?
This can affect both identity and aggregate weight.
Representative Sampling Can Matter
Forensic laboratories sometimes test only part of a larger group of apparently similar items.
Representative sampling may be scientifically reasonable in some circumstances.
But the defense may ask whether the sample was actually representative.
Factors can include:
- package integrity;
- batch identity;
- uniform appearance;
- manufacturing source;
- labeling;
- chain of custody;
- sampling method; and
- laboratory protocol.
One tested item should not automatically be treated as proof concerning every untested item without examining the scientific and evidentiary basis for that inference.
Aggregate Weight Can Change the Punishment Range
Texas controlled-substance statutes frequently use aggregate weight, including adulterants and dilutants.
In manufactured THC products, that can produce enormous punishment consequences.
A small amount of psychoactive compound may be contained within a much heavier:
- gummy;
- brownie;
- chocolate;
- beverage;
- oil;
- cartridge;
- or other product.
The applicable criminal statute and classification of the substance therefore matter enormously.
The defense should not assume that the entire gross product weight is automatically attributable to the charged controlled substance without examining the governing law and proof.
Packaging Weight Should Not Be Confused With Drug Weight
Evidence bags, wrappers, bottles, plastic containers, and retail packaging are not automatically part of the controlled-substance weight.
Laboratory records should indicate what was actually weighed.
In a threshold case, even a small discrepancy can affect the offense level.
Plant Material Presents a Different Problem
Plant-material cases may involve:
- leaves;
- flowers;
- stems;
- seeds;
- moisture content; and
- dry-weight calculations.
Because the hemp threshold is based upon dry-weight concentration, sample preparation can matter.
A raw field weight and a forensic dry-weight concentration answer different questions.
Chain of Custody Still Matters
Laboratory evidence is only useful if the tested sample can be reliably connected to the evidence seized from the accused.
The defense may examine:
seizure → packaging → evidence room → transportation → laboratory intake → storage → testing → disposition.
Relevant records may include:
- property sheets;
- evidence labels;
- seals;
- transfer records;
- laboratory accession records;
- analyst worksheets; and
- chain-of-custody logs.
A Police Report Is Not a Laboratory Report
Police reports often use broad terms:
- marijuana
- THC
- Delta-8
- Delta-9
- hemp
- THC gummy
- THC vape
Those terms may reflect packaging, appearance, statements, or an officer's belief.
The forensic question is:
What did the actual laboratory establish?
The Laboratory May Test Only Part of the Evidence
In larger seizures, laboratories may not test every single item.
That can create questions about:
- identity;
- quantity;
- representative sampling;
- count;
- batch consistency; and
- whether the untested material can legally be included in the charged weight.
A laboratory report should be read line by line rather than treated as a conclusion that everything seized was chemically identical.
What If No Quantitative THC Test Was Done?
This can be a central issue in a hemp/marijuana prosecution.
If the legal distinction depends upon Delta-9 concentration but the laboratory only performed a qualitative test showing THC presence, the defense may ask whether the State has actually established the concentration necessary to distinguish marijuana from lawful hemp.
The answer depends upon the charge, evidence, testing method, and applicable law.
But a positive THC result should not automatically be assumed to answer a concentration-based statutory question.
What the State Must Ultimately Prove
The laboratory does not decide guilt.
The State still must prove:
- the accused knowingly possessed the substance
- and the substance legally qualifies as the controlled substance alleged
- and, where punishment depends upon quantity, the legally relevant amount.
That proof may require far more than an officer saying:
"It looked like marijuana."
