Police seize a package containing twenty gummies labeled Delta-8 THC.
The crime laboratory tests one gummy.
That gummy tests positive for a controlled tetrahydrocannabinol.
The other nineteen are not chemically tested.
The prosecution then weighs all twenty and uses their combined weight to allege a serious felony.
Can Texas do that?
The answer requires separating two different concepts:
aggregate weight
and
proof of chemical identity.
Texas aggregate-weight law can permit the State to count much more than the pure amount of active controlled substance in a proven mixture.
But that does not automatically answer a different question:
What evidence establishes that the nineteen untested gummies contain the same controlled substance as the one gummy the laboratory actually analyzed?
Start With What the Laboratory Actually Did
Before arguing about the law, read the laboratory report carefully.
Do not assume that because police seized twenty gummies, the laboratory tested twenty gummies.
Determine:
- how many items police seized;
- how many items were submitted;
- how the laboratory numbered the exhibits;
- how many gummies were weighed;
- how many were chemically tested;
- which particular gummy was tested;
- whether multiple gummies were combined or homogenized;
- whether testing was qualitative or quantitative;
- which cannabinoid was identified; and
- what the analyst said about the remaining items.
Those details can radically change the analysis.
"Twenty Gummies Seized" Does Not Mean "Twenty Gummies Tested"
Police reports frequently describe evidence broadly.
A report may say:
"20 THC gummies seized."
But the laboratory report may actually establish only:
Item 1A — one gummy analyzed — Delta-8 THC identified.
The words in the police report and the scientific conclusions in the laboratory report are not necessarily the same thing.
A defense lawyer should identify exactly what the forensic scientist proved.
There Are Really Two Separate Questions
A multi-gummy case should be broken into two stages.
Question One: Chemical Identity
What evidence establishes that each item being counted contains the controlled substance charged?
Question Two: Aggregate Weight
Once the State has sufficiently established the controlled-substance mixture, what weight does Texas law permit it to use?
These questions should not be reversed.
The State should not begin with the total weight of twenty separate items and use that weight to avoid proving what those items actually contained.
Texas Aggregate-Weight Law Can Be Severe
Texas Health & Safety Code § 481.116 governs possession of Penalty Group 2 substances and uses aggregate weight, including adulterants or dilutants.
For ordinary Penalty Group 2 possession:

| Less than 1 gram | State Jail Felony |
| 1 gram or more but less than 4 grams | Third-Degree Felony |
| 4 grams or more but less than 400 grams | Second-Degree Felony |
| 400 grams or more | First-Degree Felony |
Therefore, if a THC edible is legally a Penalty Group 2 controlled-substance mixture, the prosecution may argue that the weight includes the edible material—not merely the milligrams of active THC.
That is why twenty gummies can produce a surprisingly large alleged drug weight.
But Aggregate Weight Does Not Prove Chemical Identity
This distinction is essential.
Assume one tested gummy weighs 5 grams and contains a controlled substance.
That may establish evidence concerning that gummy.
Now assume nineteen additional gummies weigh another 95 grams but were never chemically tested.
Before relying on the entire 100 grams, the State needs an evidentiary basis for treating the nineteen untested gummies as containing the same controlled substance.
The aggregate-weight statute tells us how a proven controlled-substance mixture may be weighed.
It does not magically perform chemical analysis on nineteen untested exhibits.
One Gummy and Twenty Gummies Present Different Scientific Inferences
Suppose a chemist takes a small sample from a single gummy and tests it.
If that gummy is homogeneous, the chemist may reasonably infer that the tested sample represents the remainder of that same gummy.
Now change the facts.
The chemist tests one gummy out of twenty physically separate gummies.
Extending that result to nineteen separate items requires an additional inference:
that all twenty gummies are materially alike in the characteristic being tested.
The strength of that inference depends upon the evidence.
What Is Representative Sampling?
A forensic laboratory does not necessarily need to test every unit in every drug case.
Laboratories may use representative sampling.
In appropriate circumstances, a scientifically supported sampling method can permit conclusions about a larger population without individually analyzing every item.
But "representative" is not a magic word.
The defense should ask:
What made this particular gummy representative of the other nineteen?
Were All Twenty Gummies in the Same Sealed Package?
Packaging can be powerful evidence.
Twenty apparently identical gummies recovered from one unopened, commercially manufactured package present a stronger argument for common composition than twenty loose gummies collected from different locations.
Relevant facts may include:
- whether the package was factory sealed;
- manufacturer;
- product name;
- lot number;
- batch number;
- stated dosage;
- ingredient list;
- quantity listed on the package;
- whether all twenty gummies matched the packaging description; and
- whether the package appeared altered.
These facts can strengthen—or weaken—the inference that the tested gummy represents the others.
What If the Package Was Already Open?
An open package creates additional questions.
Could gummies have been added?
Were all gummies identical?
Were different colors or shapes present?
Did the package originally contain the number police found?
Were loose gummies collected elsewhere and placed into the package?
Does body-camera video show how officers actually found them?
Chain of custody begins at the scene, not at the laboratory.
Batch and Lot Numbers Can Become Important Evidence
Commercially manufactured products frequently identify a:
batch number
or
lot number.
That information may connect the seized product to manufacturing and laboratory records.
If all twenty gummies came from the same commercial batch, that may support an inference of product uniformity.
It may also allow the defense to locate a manufacturer's Certificate of Analysis.
The Certificate of Analysis May Tell a Different Story
A Certificate of Analysis—or COA—may identify:
- Delta-8 concentration;
- Delta-9 concentration;
- THCA;
- other cannabinoids;
- batch number;
- sample date;
- testing laboratory;
- testing methodology; and
- potency per serving or product.
The defense should compare:
the seized package
to
the COA
to
the State laboratory result.
Do the batch numbers match?
Does the State's result agree with the manufacturer's result?
Did both laboratories test for the same cannabinoids?
Were both tests quantitative?
A COA Is Not Automatically Conclusive
A manufacturer's COA should not simply be accepted as gospel.
Questions can include:
- Is it authentic?
- Does it actually correspond to the seized batch?
- Who submitted the sample?
- Was the sample representative?
- Was the testing laboratory properly accredited?
- What methodology was used?
- When was the analysis performed?
But a matching COA can provide important additional evidence about the composition of the seized product.
Visual Similarity Helps—but Does Not Perform Chemistry
Suppose all twenty gummies are:
- the same color;
- same shape;
- same size;
- same approximate weight;
- and recovered from the same package.
Those facts can support the State's inference.
But visual similarity does not itself identify a cannabinoid.
Two gummies can look identical while containing different chemical formulations.
The question remains whether the totality of the evidence reliably establishes the composition of the untested items.
Weight Consistency May Matter
If the gummies are commercially manufactured, individual weights may be similar.
Suppose the laboratory records:
Gummy 1: 4.9 grams Gummy 2: 5.0 grams Gummy 3: 5.1 grams
and so forth.
Consistency can support an inference of uniform manufacturing.
Large differences may raise questions.
Weight alone, however, does not establish chemical composition.
What Does the Laboratory's Sampling Protocol Say?
The defense should consider obtaining the laboratory's written sampling procedure.
It may address:
- how many units must be tested;
- when visually similar items may be grouped;
- when statistical sampling is permitted;
- how samples are randomly selected;
- when separate exhibits require separate testing;
- whether units may be homogenized; and
- how conclusions about untested units must be reported.
Then ask:
Did the analyst follow the laboratory's own procedure?
Did the Analyst Randomly Select the One Gummy?
Sampling methodology can matter.
If an analyst simply picks the first gummy encountered, that is different from a documented random-sampling procedure designed to support an inference about a population.
Questions can include:
- How was the tested gummy chosen?
- Was the selection random?
- Did the analyst document the selection method?
- Were the gummies treated as one exhibit or twenty?
- What scientific conclusion did the laboratory's protocol permit from that sampling?
What If Several Gummies Were Homogenized?
Sometimes a laboratory may combine portions from several units and homogenize them before testing.
That creates a different evidentiary picture from testing one untouched gummy.
Counsel should determine exactly how the sample was prepared.
A report stating:
"Representative sample tested"
may not reveal whether:
- one gummy was sampled;
- several gummies were sampled;
- portions were combined;
- the entire exhibit was homogenized; or
- the analyst relied upon another sampling method.
The underlying bench notes may answer that question.
The Final Lab Report May Not Tell the Whole Story
The one-page laboratory certificate is often a summary.
Depending upon the case, the defense may need:
- analyst worksheets;
- bench notes;
- photographs;
- item descriptions;
- sample-preparation records;
- instrument data;
- chromatograms;
- spectra;
- calibration records;
- quality-control records;
- sampling protocol;
- weights;
- measurement uncertainty;
- and chain-of-custody documentation.
Those records can reveal exactly how the laboratory moved from twenty physical gummies to the conclusion stated in the final report.
Which Cannabinoid Did the One Gummy Actually Contain?
Even before extrapolating the result to the other nineteen, the defense should examine the tested gummy itself.
Did the laboratory identify:
- Delta-8 THC?
- Delta-9 THC?
- THCA?
- another tetrahydrocannabinol?
Or did the report merely say:
THC detected?
Those are not necessarily equivalent conclusions under Texas law.
Was the Testing Quantitative?
This can be especially important after the 2026 Delta-8 developments.
A qualitative test may establish that Delta-8 was detected.
But DSHS's current position recognizes naturally occurring trace amounts of Delta-8 in qualifying hemp.
If the criminal classification turns upon whether Delta-8 was merely trace or present at a manufactured or concentrated level, counsel should ask whether the laboratory actually quantified it.
The Offense Date Still Matters
Texas Delta-8 law changed substantially in 2026.
The Texas Supreme Court issued Texas Department of State Health Services v. Sky Marketing Corp. on May 1, 2026.
Rehearing was denied June 5.
DSHS's reinstated scheduling clarification became effective July 31, 2026.
A prosecution involving gummies allegedly possessed after July 31, 2026 therefore presents a different historical legal setting from a prosecution based upon conduct allegedly occurring in 2024, 2025, or early 2026.
The current legal status of Delta-8 should not simply be applied backward without analyzing the law governing the alleged offense date.
A Label Saying "Delta-8" Can Be Important
Suppose the package clearly states:
20 DELTA-8 THC GUMMIES — 25 MG EACH.
That label may provide circumstantial evidence concerning:
- intended product composition;
- number of gummies;
- manufacturer;
- dosage;
- knowledge;
- product identity; and
- batch information.
But the label is not the same thing as independent chemical analysis.
A mislabeled product is possible.
The State's scientific evidence still deserves examination.
The Label Can Also Help the Defense
The same package may contain:
- QR code;
- COA link;
- batch number;
- lot number;
- manufacturing date;
- ingredient list;
- claimed Delta-9 concentration;
- hemp representations; and
- laboratory information.
Those details may become important defense evidence.
Preserve the package.
Now Consider the Felony-Weight Consequence
Suppose:
- twenty gummies are seized;
- each weighs approximately 5 grams;
- combined net weight is approximately 100 grams;
- one gummy is tested;
- the tested gummy contains a Penalty Group 2 controlled substance.
If the State sufficiently establishes that all twenty gummies contain the same qualifying controlled substance, it may argue for an aggregate weight of approximately:
100 grams.
Under § 481.116, 100 grams falls within the:
4 grams or more but less than 400 grams
category.
That is generally a second-degree felony for possession.
The ordinary punishment range is:
2 to 20 years in prison
and
a possible fine of up to $10,000.
The difference between counting one 5-gram gummy and twenty 5-gram gummies therefore may not change the degree in this particular hypothetical—but in other quantities the inclusion of untested units can cross a statutory threshold and radically change the punishment range.
Change the Numbers and the Problem Becomes Obvious
Suppose the tested material establishes:
3.5 grams.
If that is all the State can reliably prove, a Penalty Group 2 possession allegation falls within the third-degree-felony range.
Now suppose the prosecution adds one or more separate untested items and claims:
5 grams total.
That crosses the 4-gram threshold into a second-degree felony.
The question of whether the untested material may properly be included can now affect the difference between:
2–10 years
and
2–20 years.
That is not a technical detail.
It can determine the degree of the case.
What If Testing Only the One Gummy Already Establishes the Charged Range?
Then the sampling issue may matter less to the statutory minimum weight.
Suppose the indictment alleges 4 to 400 grams and the State has properly tested a single edible weighing 10 grams.
If aggregate-weight law applies to that single proven mixture, the State may already have evidence exceeding the 4-gram threshold.
Whether the other nineteen gummies were tested may then be less important to establishing that particular punishment category.
It may still matter for other issues, but the prosecution may not need them to reach the charged threshold.
This is why defense counsel must do the math.
Do Not Fight About 100 Grams If 5 Grams Already Proves the Same Range
Defense strategy should focus on issues that can actually change the case.
If:
one properly proven gummy = 5 grams
and
twenty alleged gummies = 100 grams,
both amounts fall within the same 4-to-less-than-400-gram Penalty Group 2 possession range.
Successfully excluding nineteen gummies from the weight calculation may dramatically reduce the factual quantity without reducing the statutory offense level.
That does not make the issue irrelevant.
But counsel should understand exactly what the victory accomplishes.
Sometimes the Critical Attack Is the Classification of the First Gummy
This is an even more important point.
If the tested gummy does not legally qualify as the controlled substance charged, then arguing about the other nineteen may be unnecessary.
The defense should first ask:
- Was Delta-8 actually identified?
- At what concentration?
- Was it merely trace?
- Was Delta-9 quantified?
- Did the hemp exclusion apply?
- What law governed the offense date?
If the State cannot establish the legal classification of the tested gummy, multiplying that gummy by twenty does not fix the problem.
The Defense Should Be Careful About Requesting Additional Testing
Suppose the State tested only one gummy and the existing evidence does not establish the higher weight category it wants.
The defense might be tempted to demand:
"Test all nineteen!"
That may be strategically unwise.
Additional testing could provide the prosecution with exactly the evidence it currently lacks.
Before requesting independent or additional testing, counsel should ask:
- What has the State already proved?
- Who has the burden?
- Does the existing proof reach the charged threshold?
- What happens to the client if additional testing confirms the State's theory?
Sometimes the absence of testing is more valuable to the defense than the result of another test.
Independent Testing Can Still Be Valuable in the Right Case
There are also cases where defense testing makes sense.
For example:
- the tested gummy's result is questionable;
- a COA conflicts with the State laboratory;
- cannabinoid concentration is disputed;
- Delta-8 versus Delta-9 matters;
- the case is near a statutory threshold;
- the product may qualify as hemp; or
- sampling methodology appears unreliable.
The decision should be strategic rather than automatic.
Constructive Possession Can Make the Whole Lab Fight Secondary
Assume all twenty gummies unquestionably contain a controlled substance.
The State still must prove the accused knowingly possessed them.
If the package was found:
- beneath another passenger's seat;
- in someone else's backpack;
- in a shared residence;
- inside a hotel room with several occupants;
- or in a borrowed vehicle,
constructive-possession law may become the more important defense.
Chemical identity does not establish who possessed the substance.
The Search May Be the Bigger Issue
Likewise, perfect laboratory evidence does not cure an unconstitutional search.
Counsel should still examine:
- why the vehicle was stopped;
- duration of detention;
- consent;
- claimed marijuana odor;
- probable cause;
- K-9 deployment;
- search warrant;
- scope of search; and
- seizure of the package.
Sometimes the best defense to twenty gummies has nothing to do with gummies.
It is the Fourth Amendment.
A Practical Defense Checklist for the 20-Gummy Case
Counsel should consider asking:
- Exactly how many gummies were seized?
- Where were they found?
- Who allegedly possessed them?
- Were they in one package?
- Was the package sealed or open?
- Were all gummies visually identical?
- Was there a batch or lot number?
- Is there a Certificate of Analysis?
- Does the COA match the seized batch?
- How many gummies were submitted to the laboratory?
- How many were actually tested?
- How was the tested gummy selected?
- Was representative sampling used?
- What does the laboratory's sampling protocol require?
- Were several gummies homogenized?
- Which cannabinoid was identified?
- Was testing quantitative?
- What was the Delta-8 concentration?
- What was the Delta-9 concentration?
- Was THCA measured?
- What was the net weight?
- Was packaging excluded?
- What statutory threshold does the tested evidence alone establish?
- Does adding the untested evidence change the offense level?
- What law applied on the alleged offense date?
- Was the search lawful?
The Most Important Question Is Not "How Many Gummies?"
It is:
What can the State actually prove about them?
Twenty physical objects may be sitting in an evidence room.
That does not mean twenty independent chemical analyses exist.
At the same time, Texas law does not necessarily require twenty individual tests before a jury can infer that all twenty commercially uniform items contain the same substance.
The strength of the case depends upon the scientific sampling, packaging, batch evidence, laboratory findings, surrounding circumstances, and the legal threshold the State must prove.
The Bottom Line
Testing one gummy does not automatically mean the other nineteen disappear from the prosecution.
But neither should the State automatically receive the weight of all twenty merely because police placed them in the same evidence bag.
The proper analysis asks:
- What was actually tested?
- What supports treating the tested item as representative?
- Which cannabinoid was actually proved?
- Does the hemp exclusion apply?
- What law applied on the offense date?
- What weight does the tested evidence itself establish?
- And does including the untested material actually change the punishment range?
Those questions turn a police-report conclusion into an actual defense analysis.
